1. Acceptance of Terms
These Terms of Service and Privacy Policy (“Terms”) govern your access to and use of thecreationstationstudios.com (the “Site”), operated by The Creation Station Studios (“we,” “us,” or “our”). By accessing or using the Site, subscribing to our email list, downloading any free resource, or purchasing any consulting service, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Acceptance of these Terms may be indicated, where permitted by applicable law, through any legally recognized method of electronic assent, including without limitation: providing an electronic signature; checking an acceptance checkbox; completing a booking after these Terms have been presented; completing payment after these Terms have been presented; or clicking an “I Agree” or equivalent acceptance button. Passive browsing of the Site alone does not constitute affirmative consent to any model, likeness, property, or media release where affirmative consent would legally be required.
2. Educational Content Only — No Financial, Legal, or Tax Advice
All content on this Site — including but not limited to articles, guides, downloadable resources, videos, and statements made during consultations — is provided for general educational and informational purposes only. Nothing on this Site constitutes financial, investment, legal, tax, credit repair, or professional advice of any kind.
We are not registered investment advisors, broker-dealers, attorneys, CPAs, or credit repair organizations. You should consult a licensed professional before making any financial, legal, credit, or business decision. Your use of any information on this Site is at your own risk.
3. No Earnings, Results, or Performance Guarantee
We make no representations, warranties, or guarantees regarding income, trading results, credit score improvements, business outcomes, or any other results from using this Site, our free resources, our paid consulting services, or any third-party service referenced on this Site. Any examples, case studies, or testimonials referenced are not representative of typical or guaranteed results. Individual results vary based on factors outside our control, including your own actions, market conditions, and starting circumstances.
4. Trading & Credit Risk Disclosure
Trading Risk: Trading futures, cryptocurrency, or any financial instrument involves substantial risk of loss and is not suitable for all individuals. Past performance is not indicative of future results. Prop firm evaluations involve non-refundable fees in most cases, and passing an evaluation does not guarantee future funding, payouts, or profitability. You should only risk capital you can afford to lose.
Credit Risk: Information about credit building, credit disputes, and authorized user tradelines is educational only. Results from credit-building strategies vary by individual credit history, lender, and scoring model, and are not guaranteed. We are not a credit repair organization as defined under the Credit Repair Organizations Act (CROA), and nothing on this Site should be construed as a promise to repair, fix, or improve your credit score.
5. Third-Party Services, Links & Affiliated Brands
This Site contains links and references to third-party websites and services, including but not limited to Kevinomics LLC (kevinomics.com), Plopjoy Solutions (plopjoy.com), Authorized Trades (authorizedtrades.com), and various prop trading firms and trading platforms (e.g., NinjaTrader, Tradovate, TradingView). Some of these are separate, independently operated businesses that may be commonly owned or operated by the same individual(s) as this Site, but each operates under its own terms of service, privacy policy, and pricing.
We are not responsible for the content, accuracy, products, services, or practices of any third-party site. Reference to a third-party service does not constitute an endorsement, warranty, or guarantee of that service. We are not affiliated with, sponsored by, or endorsed by any prop trading firm, exchange, or trading platform named on this Site unless explicitly stated otherwise.
6. Paid Consulting Services
Career consultations and other paid 1:1 services offered through or referenced by this Site are professional services sold on an as-applied, individually reviewed basis. Unless otherwise stated in writing at the time of purchase:
- All consulting fees are for time and expertise rendered, not for a guaranteed outcome, result, or level of income.
- Consultations are not free, and any statement to the contrary on a third-party platform or by a third party is not authorized by us.
- Refunds, rescheduling, and cancellation terms will be disclosed at the time of booking and are governed by the specific agreement made at that time, which supplements these Terms.
7. Intellectual Property, Photography & Content Ownership
All content on this Site — including text, graphics, logos, guides, downloadable resources, and the overall look and feel of the Site — is the property of The Creation Station Studios or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent, except for personal, non-commercial use.
7.A Sole Ownership of Photography, Video & Recorded Content
The Creation Station Studios is and remains the sole and exclusive owner of all photographs, digital photographs, negatives, video, film, footage, drone footage, audio, recordings, RAW files, source files, project files, edited files, proofs, unused captures, metadata, compositions, retouched images, derivative works, and other media or creative works created, captured, recorded, edited, or produced by The Creation Station Studios, its photographers, videographers, employees, contractors, agents, or representatives (collectively, the “Content”).
All copyrights and other intellectual-property rights in the Content remain exclusively with The Creation Station Studios except where expressly assigned in a separate written copyright assignment signed by an authorized representative of The Creation Station Studios. To the fullest extent permitted by law, The Creation Station Studios retains all rights under the United States Copyright Act, including reproduction, distribution, display, publication, licensing, adaptation, derivative-work, archival, portfolio, advertising, promotional, commercial, and other exploitation rights.
ALL PHOTOGRAPHS, VIDEO, FOOTAGE, AUDIO, RAW FILES, EDITED FILES, AND OTHER MEDIA CREATED OR CAPTURED BY THE CREATION STATION STUDIOS ARE AND SHALL REMAIN THE SOLE AND EXCLUSIVE PROPERTY OF THE CREATION STATION STUDIOS. CLIENT ACQUIRES NO COPYRIGHT OR OWNERSHIP INTEREST IN SUCH MATERIAL UNLESS THE CREATION STATION STUDIOS EXPRESSLY TRANSFERS SUCH COPYRIGHT THROUGH A SEPARATE WRITTEN ASSIGNMENT SIGNED BY AN AUTHORIZED REPRESENTATIVE OF THE CREATION STATION STUDIOS.
For the avoidance of doubt, no ownership interest or copyright in the Content is transferred to any customer, client, subject, participant, property owner, or other party merely because that party: (a) hired us; (b) paid us; (c) appears in a photograph or recording; (d) owns the property depicted; (e) commissioned the shoot; (f) possesses a copy of a delivered file; or (g) received a digital delivery of a photograph or video.
7.B No Work-Made-for-Hire Presumption
Commissioning, requesting, or paying for photography, videography, or content-creation services does not make the Content a “work made for hire” for the customer or any other party, and no implied assignment, copyright transfer, or joint-authorship arrangement is created, unless a separate written agreement expressly provides otherwise and applicable copyright law permits that treatment. Nothing in these Terms shall be construed as effecting a work-made-for-hire arrangement in favor of the customer.
7.C Client Usage License
Unless otherwise expressly agreed in a signed writing, delivery of final photographs or video grants the customer only a limited, non-exclusive, non-transferable license to use the delivered final Content for the personal or commercial purpose for which the shoot was booked. This license does not transfer copyright, does not convey ownership of RAW or source files, and does not authorize the customer to: (i) claim authorship of the Content; (ii) transfer, assign, or purport to transfer copyright to any third party; (iii) sell the Content as stock photography or similar licensing inventory; (iv) sublicense the Content independently of the customer’s own permitted use; (v) sell RAW, source, or project files; (vi) remove copyright notices, credit lines, or watermarks where applicable; or (vii) represent that the customer or any third party created the Content.
7.D RAW Files, Source Files & Working Materials
RAW files, source files, project files, working files, unused captures, negatives, metadata, and editing files are proprietary materials of The Creation Station Studios. Such materials are not part of the standard delivery, and The Creation Station Studios is under no obligation to release, transfer, or license those materials unless the parties expressly agree otherwise in writing signed by an authorized representative of The Creation Station Studios.
7.E Copyright Transfer Requires a Separate Written Assignment
Copyright ownership in the Content may only be transferred by a separate written copyright assignment that (a) clearly identifies the specific works being transferred, (b) expressly states that copyright ownership is being assigned, and (c) is signed by an authorized representative of The Creation Station Studios. None of the following, standing alone, constitutes a copyright assignment or transfer of ownership: payment; an invoice or receipt; a booking confirmation; possession of files; a download or delivery link; a text message; ordinary email correspondence; delivery of edited photographs or video; or posting the Content online.
7.F Portfolio & Marketing Rights
Subject to applicable privacy and publicity law and any express written confidentiality limitation agreed by the parties, The Creation Station Studios retains a perpetual, royalty-free, worldwide right to use the Content in its portfolios, on its websites, in its social-media channels, in advertisements and sales presentations, in award and competition submissions, and in other promotional or demonstration materials related to its services.
7.G Image Ownership (Legacy Provision)
When using our services we maintain irrevocable ownership over all of our images taken at our facilities, and we do not grant permission to have any work we record to be publicly or commercially displayed and/or used.
By using our services you agree to only use your images for the intended purpose of submitting for self-tape audition opportunities, voice-over opportunities, or agent or manager meetings. Anything else must be approved by The Creation Station Studios.
8. Consent to Photography and Recording
By engaging our photography, videography, or content-creation services, participating in a shoot, or knowingly permitting yourself to be photographed or recorded by us, you authorize The Creation Station Studios and its photographers, videographers, employees, agents, assistants, contractors, representatives, successors, licensees, and assigns to photograph, film, videotape, record audio, and otherwise record you, your voice, your performance, and your activities in connection with the authorized services.
Where a client, customer, business, or organization books our services, that party represents and warrants that it has the authority to authorize the photography and recording contemplated by the booking and that it will separately obtain any additional consent from employees, guests, contractors, models, participants, property owners, or other third parties where such consent is legally required. Nothing in these Terms shall be construed as one party purporting to waive independent legal rights that belong to an unrelated third party.
9. Model, Likeness & Publicity Release
To the maximum extent permitted by applicable law, each consenting participant grants The Creation Station Studios the irrevocable right and permission to use the participant’s image, likeness, appearance, voice, statements, performance, and (where authorized) name in connection with the Content, and to reproduce, edit, retouch, crop, alter, composite, publish, display, distribute, archive, license, advertise with, promote with, exhibit, publicly display, and create derivative works from the Content.
Permitted uses include, without limitation: the company portfolio; the company website; social-media channels; advertisements; marketing and promotional materials; brochures; sales presentations and demonstrations; publications; award and competition submissions; educational and editorial materials; case studies; and commercial promotional materials.
To the maximum extent permitted by applicable law, each consenting participant waives any right to inspect or approve the finished Content or the specific use to which the Content may be applied. This release does not attempt to waive rights that cannot lawfully be waived in advance under applicable law.
9.A Model / Actors / Artist Release (Legacy Provision)
By using our service and agreeing to our Terms, you grant us irrevocable authorization to use, publish, reuse, republish, distribute, disseminate, or otherwise make publicly available for any artistic or commercial use — including advertising, publication, news, or illustration — images of you, if said images were taken with our equipment.
Whether individually or collectively with any other material, in any and all forms of media now known or hereinafter developed, including but not limited to print media, digital media, the internet, and composite or distorted images, or for any other lawful use as may be determined by The Creation Station Studios in its sole and exclusive discretion, including the use of your name without restriction. The Creation Station Studios shall be specifically permitted to use fictitious names in conjunction with the images.
By using our services you further completely agree to release and discharge The Creation Station Studios from any and all demands or claims that may arise out of or otherwise be connected with the use of The Creation Station Studios featuring you, your image, or your property, including without limitation any and all claims for violation of a right of publicity, a right of privacy, or libel. You also waive any and all rights to approve or otherwise review any uses of the photographs or video featuring you, your image, or your property.
This authorization and release shall inure to the benefit of the legal representatives, licensees, heirs, and assignees of The Creation Station Studios and shall also be binding upon you and your heirs, assignees, and legal representatives.
10. Property / Location Release
The client represents and warrants that, with respect to each location at which the services are performed, the client either (a) owns or lawfully controls the location or property; or (b) has sufficient authority from the owner or lawful controller of the location or property to permit The Creation Station Studios to enter, photograph, and record the location and property.
Subject to that representation, the client authorizes The Creation Station Studios to photograph and record, as applicable: interiors; exteriors; homes; commercial properties; buildings; rooms; furnishings; landscaping; vehicles; equipment; products; décor; artwork where legally permitted; job sites; installations; completed work; before-and-after conditions; and other visible property involved in the shoot.
Ownership by The Creation Station Studios of a photograph or recording does not automatically override independent intellectual-property, trademark, privacy, or publicity rights that may belong to third parties depicted in or associated with the Content, and the client is responsible for obtaining any additional permissions from such third parties where legally required.
11. Client Representations & Third-Party Permissions
The client represents and warrants that: (a) the client has authority to request the photography and content-creation services; (b) the client has authority to authorize access to the location(s) at which the services will be performed; (c) any logos, photographs, artwork, trademarks, designs, documents, music, or other content the client provides to The Creation Station Studios may lawfully be provided and used for the requested project; and (d) the client will obtain any legally required permissions from models, employees, contractors, guests, property owners, or other third parties whenever the client is responsible for arranging those participants or locations.
To the maximum extent permitted by applicable law, each client and each consenting participant hereby releases The Creation Station Studios and its owners, members, managers, officers, employees, photographers, videographers, contractors, agents, assistants, affiliates, successors, assigns, representatives, and licensees from any and all claims arising out of or relating to the authorized creation, capture, recording, editing, cropping, retouching, reproduction, publication, display, distribution, portfolio use, advertising, promotional use, licensing, and other authorized exploitation of the Content, including claims concerning likeness, privacy, publicity, portrayal, editing, cropping, publication, and reproduction, to the extent such rights may lawfully be released in advance.
This release does not purport to waive claims for intentional misconduct, fraud, or any other claim that applicable law prohibits from being released in advance.
13. User Conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the Site or its related systems; (c) interfere with or disrupt the Site’s functionality; (d) scrape, harvest, or collect information from the Site by automated means without our consent; or (e) impersonate any person or entity in connection with your use of the Site.
14. Age & Eligibility Requirements
This Site is intended for individuals who are at least 18 years old. By using this Site, subscribing to our email list, or purchasing any service, you represent that you are at least 18 years of age and legally capable of entering into these Terms. This Site is not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13. See Section 22 for more detail.
15. Limitation of Liability
To the fullest extent permitted by law, The Creation Station Studios, its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, credit-related damages, or business interruption, arising out of or related to your use of the Site, any free or paid content, or any third-party service referenced on the Site — even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site or its services shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
16. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, release, and hold harmless The Creation Station Studios and its owners, members, managers, officers, employees, photographers, videographers, contractors, agents, assistants, affiliates, successors, assigns, representatives, and licensees from and against any and all third-party claims, liabilities, losses, damages, judgments, settlements, penalties, expenses, and reasonable attorneys’ fees arising out of or relating to: (a) your breach of these Terms; (b) your use of the Site; (c) your violation of any rights of a third party; (d) instructions you provide to us in connection with a shoot or content-creation engagement; (e) materials, logos, photographs, artwork, trademarks, designs, documents, music, or other content you provide to us; (f) any lack of authority on your part to permit entry to a location or to authorize photography or recording at that location; (g) any lack of permission from a property owner or lawful controller of a location; (h) any failure by you to obtain required consent from models, participants, employees, contractors, guests, or other persons whose consent you were responsible for arranging; (i) intellectual-property claims involving content you supplied to us; (j) privacy or publicity claims arising from permissions you were responsible for obtaining; (k) trademark or copyright claims involving materials you supplied to us; (l) unauthorized or unlawful use by you of any Content we deliver; and (m) representations you made concerning your authority or the permissions you obtained.
This provision does not attempt to waive, release, or immunize intentional misconduct, fraud, gross negligence, or any other conduct that applicable law prohibits from being released or indemnified in advance.
17. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith informal negotiation. If unresolved within thirty (30) days, such dispute shall be resolved by binding arbitration administered in accordance with the rules of a mutually agreed arbitration provider, conducted in the State of Texas, rather than in court, except that either party may bring an individual claim in small claims court. You and we each waive any right to a jury trial or to participate in a class action.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles, except where superseded by applicable federal law.
19. Survival
The provisions of these Terms concerning copyrights, intellectual property, ownership of Content, licenses, releases, indemnification, payment obligations, dispute resolution, limitation of liability, and representations and warranties shall survive the completion, cancellation, expiration, or termination of any services provided by The Creation Station Studios and shall continue in full force and effect thereafter.
